1. Acceptance of Terms
By accessing and using Reactions (“the Service”), you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to abide by the above, please do not use this service.
2. Description of Service
Reactions is a platform that allows product teams to gather early feedback on conceptual features from real users before shipping. The Service includes web-based tools for creating feedback projects (including videos, Looms, Figma prototypes & slides, mockups, and surveys), sharing those projects via links or embeddable widgets, and collecting and analyzing user responses such as emoji reactions, comments, votes, and survey answers.
When you share a project publicly or embed a feedback widget on your site, non-registered participants (“viewers”) may provide their name, email, and feedback. You are responsible for ensuring viewers are appropriately informed that their feedback is being collected on your behalf through the Reactions platform.
3. User Accounts
To access certain features of the Service, you must register for an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
4. Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to use the Service:
- In any way that violates any applicable federal, state, local, or international law or regulation
- To transmit, or procure the sending of, any advertising or promotional material, or any other form of similar solicitation
- To impersonate or attempt to impersonate the Company, a Company employee, another user, or any other person or entity
- To collect feedback from individuals without their knowledge or consent
- To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Service
5. User Content
You retain ownership of all content you upload, create, or submit through the Service, including project descriptions, uploaded assets, Figma files, and feedback data collected from your viewers (“User Content”).
By submitting User Content, you grant Reactions a limited, non-exclusive, royalty-free license to store, process, and serve that content solely as necessary to operate the Service for you. This license terminates when you delete the content or close your account.
You represent and warrant that you have all rights necessary to upload or share any content you submit, and that your content does not infringe the intellectual property, privacy, or other rights of any third party.
6. Subscription and Billing
The Service is offered on a subscription basis. Available plans include Solo (free), Team, and Scale. Paid plans are billed monthly or annually through Stripe, our payment processor.
- Cancellation. You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period; you will retain access to paid features until that date.
- No refunds. Subscription fees are non-refundable. We do not issue pro-rated refunds for partial billing periods.
- Failed payments. If a payment fails, we will retry the charge and notify you by email. Continued failure to pay may result in downgrade to the Solo (free) plan.
- Plan changes. You may upgrade or downgrade your plan at any time. Upgrades take effect immediately; downgrades take effect at the end of the current billing period.
- Data on termination. Following account deletion or subscription cancellation, your data is retained for up to 30 days to allow for export. After that period, data is permanently deleted. We recommend exporting your data before cancelling.
7. Privacy Policy
Your privacy is important to us. Please review our Privacy Policy, which also governs your use of the Service, to understand our practices.
8. Intellectual Property Rights
The Service and its original content, features, and functionality are and will remain the exclusive property of Reactions and its licensors. The Service is protected by copyright, trademark, and other laws. Your User Content remains your property as described in Section 5.
9. Termination
We may terminate or suspend your account immediately, without prior notice or liability, if you breach these Terms. Upon termination, your right to use the Service will cease immediately. You may export your data at any time before termination; following termination, data is retained for up to 30 days then permanently deleted.
10. Disclaimer and Limitation of Liability
The Service is provided on an “as is” and “as available” basis, without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.
To the fullest extent permitted by applicable law, Reactions and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, or goodwill — arising out of or in connection with your use of the Service, even if advised of the possibility of such damages.
In no event shall our total liability to you for all claims arising out of or related to these Terms or the Service exceed the greater of (a) the total fees paid by you to Reactions in the twelve (12) months immediately preceding the event giving rise to the claim, or (b) one hundred US dollars ($100).
11. Indemnification
You agree to defend, indemnify, and hold harmless Reactions and its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms, your User Content, or your use of the Service in a manner not authorized by these Terms.
12. Governing Law and Disputes
These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.
Before initiating any formal dispute, you agree to first contact us at lastpicked@proton.me and attempt to resolve the issue informally. If the dispute is not resolved within 30 days, either party may pursue available legal remedies. Any legal action relating to these Terms shall be brought exclusively in the state or federal courts located in California.
13. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice by email or by posting a prominent notice on the Service prior to any new terms taking effect. Your continued use of the Service after changes become effective constitutes your acceptance of the revised Terms.
